MACPO’S Position on Employment of Case Aide, Assistant Probation Officer, or Similar Positions

Background
As a result of proposed legislation, a workgroup of MACPO members met to review the existing practices for the use of case aides in CPO counties.  After reviewing information supplied by the various Directors, the workgroup decided to combine the position descriptions for existing Case Aide, Assistant Probation Officer, and other similar positions.  They could then focus on the differences between this combined group and appointed Probation Officers in the key areas of  Minimum Education Requirements,  Independence of Action / Level of Decision Making, and Types of Assigned Cases.  It was believed that by this process, a clear delineation between appointed probation officers and the existing case aide, assistant probation officer, and similar positions could be determined.

Recommendations for Minnesota counties operating under M.S. 244.19:

  • CPO Directors should strive for consistency in their hiring practices and assignment of duties of their case aide, assistant probation officer, or similar personnel.

  • Position Description Guidelines for case aides, assistant probation officers, or similar  personnel:

    • Minimum of High School graduate with corrections work experience.  (Prefer an A.A. or B.A.)

    • Main duty is monitoring of low risk adult and juvenile offenders.
      Restricted from giving courtroom recommendations or direction for court action.

    • Restricted from developing a treatment plan for offenders.

    • Restricted from completing formal offender assessments such as Chemical Use Assessments and/or Domestic Assault Investigations with sentencing recommendations.

    • Restricted from submitting formal reports to court for action without signed approval of a Probation Officer.

    • Restricted from signing Apprehension & Detention Orders.

The MACPO Legislative Committee assigned an "Option 60" sub-committee to look into an early retirement option for probation officers and corrections agents funded by increased employee contributions to PERA.

PERA conducted an actuarial study in 2008, and the findings were presented to MACPO on April 20th, 2009. Here are the results of the study in PDF format. Also, an informational newsletter was put together in October 2009, explaining the Early Retirement Option and how it works in PDF format.
